1. Applicability
These terms apply to the use of the Zwemlesmaatje app, offered by Bobika. By using the app, you agree to these terms.
2. License
You are granted a non-exclusive, non-transferable right to use the app for personal, non-commercial use.
3. Subscriptions & Payments
- Zwemlesmaatje Premium: Subscriptions are managed via Apple App Store or Google Play Store.
- Payment: Paid in advance per period (monthly/yearly).
- Cancellation: You can cancel at any time via your App Store or Play Store account settings.
- Subscriptions & Renewals: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current billing period. Your account will be charged for renewal within 24-hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your App Store or Google Play Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
- Refunds: Digital content policies apply; refunds are handled by Apple or Google.
- Premium threshold & email notice: Features for levels 4–7 are reserved for Premium subscribers. Once a swimmer surpasses Level 3, the swimming instructor is entitled to send one single email via the application to the linked parent or user, with a friendly request to subscribe to Premium. This email is a standardized template from Zwemlesmaatje and the content cannot be edited by the instructor. By using the app you agree to receiving this one-time notification. This notification cannot technically be sent if the user already has a premium account.
4. Liability
- Zwemlesmaatje is a tool for tracking and motivation. It is not a substitute for professional swimming lessons or supervision.
- Bobika is not liable for any damages resulting from the use of the app, unless due to intent or gross negligence.
- Safety: Swimming involves risks. Always supervise children near water.
5. User Generated Content (UGC)
If you post content (photos, text):
- You guarantee you hold the rights (e.g., photo of your own child).
- Reporting: Users can report inappropriate content or abusive users directly within the app or by contacting us. We reserve the right to remove any content and block users who violate our policies within 24 hours of a report.
- We have zero tolerance for hateful, illegal, or pornographic content. Accounts die dit schenden worden direct geblokkeerd.
6. Amendments
We may update these terms. Major changes will be notified within the app.
7. App Store & Platform Specific Terms
If you downloaded the App from the Apple App Store or Google Play Store, the following terms apply:
- Acknowledgement: You acknowledge that these Terms are between you and Bobika only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Bobika is solely responsible for the App and its content.
- Scope of License: The license granted to you is a limited, non-transferrable license to use the App on any Apple-branded or Android product that you own or control, as permitted by the Usage Rules set forth in the respective App Store Terms of Service.
- Maintenance & Support: Bobika is solely responsible for providing any maintenance and support services for the App. Apple and Google have no obligation whatsoever to furnish any maintenance and support services for the App.
- Warranty: Bobika is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the App.
- Product Claims: You acknowledge that Bobika, not Apple or Google, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, Bobika, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the App.
- Third-Party Beneficiary: You and Bobika acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
